Terms of Service

Please read these Terms of Service ("Terms") carefully before using FluidType ("the Software"). By downloading, installing, or using the Software, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Software.

1. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software on devices you own or control.

Permitted Use

  • Install and use the Software for personal or commercial purposes
  • Make backup copies for archival purposes
  • Transfer the Software to a new device you own (deactivating the old device)

License Restrictions

  • You may not sublicense, sell, resell, or transfer the license to others
  • You may not distribute copies of the Software to third parties
  • The license is valid only for the version purchased unless otherwise specified

2. Subscription and Purchases

Base Edition

A one-time purchase that grants you a perpetual license to use the version you purchased. Major version upgrades may require an additional purchase.

AI Pro Subscription

A recurring subscription that provides access to AI-powered features. Subscription terms:

  • Billed monthly or annually at the rate displayed at purchase
  • Automatically renews unless cancelled before the renewal date
  • You can cancel anytime through your account settings
  • No refunds for partial subscription periods after cancellation

Pricing Changes

We reserve the right to change pricing. For subscriptions, price changes will take effect at the next renewal period. We will notify you of price increases in advance.

3. Refund Policy

If you are not happy with your purchase, you may contact us for refund assistance.

  • Direct purchases: Refund requests are reviewed according to applicable law and payment processor policy
  • App Store purchases: Refunds are subject to Apple's refund policy

4. Intellectual Property

Our Rights

The Software, including its code, design, graphics, and documentation, is owned by us and protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

Your Content

You retain all rights to your content (text, custom dictionary entries, etc.). We do not claim any ownership over your input or personal data.

Feedback

If you provide feedback or suggestions, we may use them to improve the Software without obligation to you.

5. Prohibited Uses

You agree not to:

  • Reverse engineer, decompile, or disassemble the Software
  • Modify, adapt, or create derivative works based on the Software
  • Remove or alter any proprietary notices or labels
  • Use the Software for any unlawful purpose
  • Attempt to circumvent any license restrictions or security measures
  • Use the Software to infringe on the rights of others
  • Distribute malware or harmful code through the Software

6. AI Features

If you use AI-powered features, you additionally agree to:

  • Use AI features in compliance with applicable laws
  • Not use AI features to generate harmful, illegal, or misleading content
  • Accept that AI outputs may not always be accurate or appropriate
  • Not rely solely on AI outputs for critical decisions

AI features are subject to availability and may be modified or discontinued at our discretion.

7. Updates and Changes

We may release updates to the Software that include bug fixes, new features, or security improvements. We reserve the right to:

  • Modify, suspend, or discontinue any feature at any time
  • Require you to accept updates to continue using the Software
  • Change these Terms with notice to you

Continued use of the Software after changes constitutes acceptance of the new Terms.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF RESULTS

We do not warrant that the Software will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to or use of our services
  • Damages resulting from any third-party content or services

Our total liability shall not exceed the amount you paid for the Software in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Software
  • Your violation of these Terms
  • Your violation of any rights of another party

11. Termination

We may terminate or suspend your license immediately if you violate these Terms. Upon termination:

  • Your license to use the Software ends
  • You must delete all copies of the Software
  • Provisions that should survive termination will remain in effect

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Software shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Software. They supersede any prior agreements or understandings.
